NOTICE OF PRIVACY PRACTICES

This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

Our Legal Duty

We are required by law to:

• Maintain the privacy of your protected health information (PHI).
• Provide you with this notice of our legal duties and privacy practices.
• Follow the terms of this notice currently in effect.
• Notify you if your information is breached in a way that compromises its security or privacy.

How We May Use and Disclose Your Information

We may use or disclose your PHI without your written authorization in the following situations:

Treatment

To provide, coordinate, or manage your health care and related services. For example, we may disclose information to doctors, nurses, case managers, or other providers involved in your care.

Payment

To obtain payment for services provided to you. This includes billing your insurance or AHCCCS health plan.

Healthcare Operations

To support our operations such as quality assessment, training, licensing, or compliance audits.

Appointment Reminders & Follow-up

We may contact you to remind you of appointments or follow-up care.

As Required by Law

We will disclose PHI when required by federal, state, or local law.

Public Health and Safety

We may disclose PHI to:

• Report abuse, neglect, or domestic violence.
• Prevent or reduce a serious threat to health or safety.
• Report to public health authorities.

Health & Regulation Oversight

We may share information with government agencies for audits, investigations, and licensure.

Legal Proceedings

We may disclose PHI in response to a court order, subpoena, or administrative request.

Law Enforcement

When required, we may share PHI to locate a suspect, report a crime, or support law enforcement investigations.

De-identified or Limited Data

We may use de-identified data or limited data sets for research or analytics, in compliance with HIPAA.

Uses and Disclosures Requiring Your Authorization

We must obtain your written authorization for:

• Psychotherapy notes (except for limited use such as treatment or legal requirements).
• Marketing purposes.
• Sale of your health information.
• Any other purpose not described in this notice.

You may revoke your authorization at any time in writing.

Your Privacy Rights

You have the right to:

• Request Restrictions on certain uses/disclosures of your PHI.
• Request Confidential Communications (e.g., to be contacted at a different address or phone number).
• Inspect and Copy your health records.
• Request Amendments to your records.
• Receive an Accounting of disclosures.
• Receive a Paper Copy of this notice.
• File a Complaint if you believe your rights have been violated.

We will not retaliate against you for filing a complaint.

CLIENT RIGHTS AND RESPONSIBILITIES

As a client of One Small Step, and if you are a patient identified as Seriously Mentally Ill (SMI), you have the right to receive treatment and services that promote your dignity, safety, and recovery. These rights are protected by Arizona law (A.R.S. § 36-504, A.A.C. R9-21) and federal law, including HIPAA.

Your Rights as a Client

As a client of this facility, you have the right to:

• Be treated with dignity, respect, and fairness, regardless of race, religion, gender, age, sexual orientation, or disability.
• Receive care that supports your cultural and personal values.
• Participate in the development of your service plan.
• Be informed of your diagnosis, treatment options, and prognosis.
• Be free from restraint or seclusion.
• Refuse treatment or medication (unless required by law).
• Voice grievances or file complaints without fear of retaliation.

  • Patients have the right to file a complaint to their insurance plan

• Review your medical records.
• Receive services in the least restrictive environment.
• Have confidentiality protected in accordance with HIPAA, AHCCCS, and state law.
• Request a second opinion from another provider.
• Access interpretation or translation services free of charge.

Your Responsibilities as a Client

As a client, you are responsible for:

• Providing accurate and complete information about your health and behavior.
• Participating actively in your treatment and recovery plan.
• Following rules and policies of the facility.
• Treating staff and other clients with respect.
• Keeping appointments or notifying the facility in advance if you cannot attend.
• Informing your provider of any changes in medications, symptoms, or circumstances.
• Using services appropriately and only for lawful purposes.
• Reporting any dissatisfaction or concerns about your care promptly.

• Recibir atención que respete sus valores culturales y personales.

• Informar cambios en medicamentos, síntomas o circunstancias.
• Usar los servicios de manera apropiada y legal.
• Reportar cualquier insatisfacción o preocupación sobre su atención oportunamente.
