1. Introduction

Welcome to One Small Step ("the App"), a digital marketplace that connects certified peers ("Peers") with individuals seeking support for substance abuse ("Users"). These Terms and Conditions ("Terms") govern your use of our platform and services. By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use the App.

2. Eligibility

To use the App, you must be at least 18 years old and legally capable of entering into binding contracts. By using the App, you represent and warrant that you meet these eligibility requirements.

3. Services

The App provides a platform for Users to connect with certified Peers for support through video calls, phone calls, and messaging. The App itself does not provide medical, psychological, or therapeutic services. The App is not a crisis response or emergency service. If you are experiencing a medical or mental health emergency, please call 911 or a national crisis lifeline (such as 988) immediately. All interactions between Users and Peers are strictly for peer support purposes.

4. HIPAA and 42 CFR Part 2 Compliance

We are committed to protecting your privacy and ensuring the security of your personal health information (PHI). Our services comply with the Health Insurance Portability and Accountability Act of 1996 (HIPAA), 42 CFR Part 2 (Confidentiality of Substance Use Disorder Patient Records), and other relevant privacy laws. All personal information collected, stored, and shared within the App is handled in accordance with our Privacy Policy and applicable legal standards.

5. Account Registration

To use the App, Users and Peers must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

By providing your phone number and using the App, you consent to receive electronic communications, including text messages (SMS), from One Small Step. These communications may include service updates, appointment reminders, and follow-up care related to your peer support. You acknowledge that text messaging has inherent privacy and security limitations and is not a completely secure method of transmitting personal health information. Standard message and data rates may apply. You may opt out of receiving text messages at any time by replying "STOP" to any message you receive from us.

6. Fees and Payment

Users may be required to pay fees for certain services provided through the App. All fees and charges are outlined clearly in the App before the service is provided. Payment must be made through the App's designated payment system. All payments are non-refundable unless otherwise stated.

7. Code of Conduct

All Users and Peers are expected to interact respectfully and professionally. Any behavior deemed inappropriate, abusive, or harmful may result in the suspension or termination of your account. We reserve the right to monitor, record, and transcribe interactions (including video calls and messaging) for quality assurance, engineering, research, and compliance purposes.

8. Limitation of Liability

The App provides a platform for connecting Users with Peers but does not guarantee the effectiveness or outcomes of any interactions. We are not responsible for any harm, loss, or damage resulting from your use of the App or interactions with Peers. Your use of the App is at your own risk.

9. Intellectual Property

All content, trademarks, logos, and other intellectual property on the App are the property of Small Step, Inc. or its licensors. You may not use, reproduce, or distribute any content from the App without our prior written permission.

10. Privacy Policy

Your use of the App is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. Please review the Privacy Policy carefully.

11. Termination

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without notice or liability, if we believe you have violated these Terms or engaged in conduct that may harm the App or other users.

12. Changes to the Terms

We may update these Terms from time to time to reflect changes in our services or legal obligations. We will notify you of any significant changes by posting the new Terms on the App or through other communication channels. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law principles. Any disputes arising under these Terms will be resolved in the courts of Delaware, USA.

One Small Step acknowledges that specific patient rights, healthcare protections, and grievance procedures related to the clinical or peer support services you receive may be governed by the laws of the state in which you reside or receive treatment. For example, eligible clients receiving services in Arizona retain all rights and protections afforded under Arizona law and federal regulations (such as 42 CFR Part 2 and HIPAA). Nothing in these Terms is intended to limit, waive, or supersede those specific statutory patient rights.
